Terms and Conditions of Sale – Pharmacies

1. Purpose

The present General Terms and Conditions of Sale (hereinafter “GTC”) govern the sales of
dietary supplements in powder form on the website on the website O’CARE
(hereinafter “the Website”).

They are concluded between:

  • O’CARE, hereinafter referred to as “the Seller,”
  • and any natural person of legal age acting in the capacity of a consumer, hereinafter referred to as “the Customer.”

Any order implies full and complete acceptance of these Terms and Conditions.

O’CARE – KERLAB, a simplified joint stock company (SAS) with capital of €20,000, registered in the National Register of Companies (RNE) under a15> number SIREN 944 903 756 and in the RCS of Dijon, whose the headquarters is located at 13 rue des Roses, 21000 Dijon, France.

2. Products

The products offered are food supplements in powder form, compliant with
French and European regulations in force at the time of their manufacture. a14> time of their release onto the market.

The products:

  • are not drugs,
  • cannot replace a varied and balanced diet,
  • are not a substitute for medical advice or follow-up.

The essential characteristics of the products are described on the Website.

Offers are valid while supplies last.

3. Price

Prices are quoted in euros, including all taxes.

Shipping costs are specified before the order is finalized.

The Seller reserves the right to modify its prices at any time, without retroactive effect.

Products are invoiced based on the prices in effect at the time of the order.

4. Order

Any order placed on the Site constitutes a sales contract.

Before validation, the Customer may verify the details of their order and correct any errors. a7> order and correct any

Confirmation of the order constitutes express acceptance of these Terms and Conditions.

The Seller reserves the right to refuse or cancel any order in the event of:

  • existing dispute with the Customer,
  • payment incident,
  • abnormal or fraudulent order.

5. Payment

Payment is due immediately upon ordering.

Methods of payment accepted:

  • Bank card
  • PayPal
  • Apple Pay

Payments are secured via certified payment providers.

If payment is refused, the order is automatically canceled.

6. Delivery

6.1 Terms and conditions

Deliveries are made in France, the European Union, and internationally, to the address provided by the Customer when placing the order.

A shipping confirmation email containing a tracking number is sent to the Customer.

6.2 Deadlines

The delivery times are provided for informational purposes only:

  • France: 2 to 5 business days

The Seller shall not be held liable for delays attributable to the carrier.

6.3 Customs

For deliveries outside the European Union, any customs duties or local taxes may be required and remain the responsibility of the Customer.

7. Right of withdrawal

In accordance with Article L221-18 of the Consumer Code, the Customer has a period of 14 calendar days from receipt of the product to exercise their right of withdrawal.

The products must be:

  • not open,
  • not used,
  • returned in their original packaging.

To exercise this right, the Customer must notify their decision by email to the address indicated on the
Website.

8. Returns and refunds

Return shipping costs are the responsibility of the Customer.

After receipt and verification of the returned product, the refund will be made via the original payment method within a maximum period of 14 days.

Opened, damaged, or incomplete products are non-refundable.

Sale or promotional items are non-refundable, except in the case of proven defects.

9. Legal warranties

The products benefit from the legal guarantees provided for by law:

  • Legal guarantee of conformity (Articles L217-3 to L217-20 of the Consumer Code)
  • Warranty against hidden defects (Articles 1641 to 1649 of the Civil Code)

The Customer may choose between repair, replacement, or reimbursement, in accordance with the applicable legal conditions.

The warranty does not cover:

  • improper use,
  • a preservation defect,
  • normal wear and tear.

10. Liability

The Seller shall not be held liable:

  • improper use of products,
  • adverse effects related to inappropriate consumption,
  • indirect damages (loss of revenue, moral damages).

The information on this Site does not replace medical advice.

11. Intellectual Property

All content on the Website (text, images, logos, graphics) is protected by intellectual property law.

Any reproduction or use without prior authorization is strictly prohibited.

12. Personal data (GDPR)

Personal data is collected for:

  • order processing,
  • customer relationship management.

In accordance with the GDPR, the Customer has the right to access, rectify, oppose, transfer, and delete their data.

13. Cookies

The Site uses cookies that are necessary for its operation and to improve the user experience.

14. Force majeure

The Seller shall not be held liable in the event of non-performance or delay due to a force majeure event within the meaning of Article 1218 of the Civil Code.

15. Applicable law – Disputes

These Terms and Conditions are subject to French law.

In the event of a dispute, an amicable solution will be sought before any legal action is taken.

Failing this, the competent courts shall be those designated by the Code of Civil Procedure.
